Absurd Notices of Violation of the CC&Rs

I would greatly appreciate it if you could post the following topic as a point of discussion, as I know I'm not the only Parkridge resident dealing w/ obsurd notices of violation of the CC&Rs.

I received in the mail today a notice of violation of rule 20 of the CC&Rs. Rule 20 reads as follows to save everyone some time:

"It is prohibited to hang clothing, towels, rags, rugs, etc., from the windows, railings, fences or from any of the facades of the development."

I was cited as violating this rule for hanging planter boxes (for flowers)from my balcony railing.

Now, being a logical man, and having read the rule in question, I know for a fact that my planter boxes would not be considered rags, clothing, rugs, or towels, so therefore I've deduced that my planter boxes are falling under the "etc." portion of this rule.

Is it just me or is it unreasonable to assume that I should have know that planter boxes would be considered in the same category as someone hanging their laundry out to dry on their balcony railing?

I would love to hear replies as to whether anyone else has received a similar violation, or has an explanation as to why a planter box is a violation when I've noticed several other units w/ items such as bird feeders, wind chimes, and other random itesm hanging from their balconies.

Yes sir! We got one too! Planters facing inward toward your porch if you keep it neat in respect to improving your view is kind of nice- it seems to spruce up an otherwise boring deck! But our $50 fine was in my opinion ridiculous! If you recall last Friday we had some windy/stormy weather that really dumped a ton of branches and leaves all over our porch since we are on top with no protection from the wonderful trees looming over our porch. To help protect our deck we laid down a thin green piece of astro turf to save a little wear and tear on its surface. My mother in law stopped by to meet us and took it upon herself to clean up the mess the storm left behind (lucky me) but while draping the astro turf over the porch for about 25 to 30 minutes to sweep, we apparently violated the rule long enough to receive the $50 ticket! That’s BULL! I had already received a ticket last July for leaving a towel over the rail for a day that I admit was my fault. So I know I learned a lesson from that but come on! THE ASTRO TURF WAS NOT NAILED TO THE PORCH OR DRAPED OVER NIGHT! Is this what I should expect to happen every time I do something in eye shot of Rene's condo? (Since I live right in front of his place) Is he watching every move we make just to find a reason to fine us? I don't know if I’ll get a fine for farting upwind of his condo next! I feel a little creped out knowing that he is watching us, mabey a little too close! My wife will not go to any meetings since he belittled her in front of everyone after he literally followed her from the pool to our condo just so he could see where she lived so he could send us a letter about not closing the gate all the way at the pool that she did not even leave ajar! (She just has a tendency to talk back to people who bully others at the pool) then followed the fine for the towel. I know Rene will read this so I want him to prepare for an earful at the next meeting-I AM NOT AFRAID OF YOU- and neither should anyone else for that matter. PEOPLE, if you can complain on this message board then join me at the next meeting and express you concerns to the board. I may have to fill out 10 complaint forms- and if this speeds up the process of getting things done quick around here like the repairs to the club house for Rene's Birthday Party then so be it! Fill out them forms!

It'll definately be the "etc" portion of the rule. Problem is, The Board enforces the rules based on "THEIR" interpretation and not what seems logical. Jusst something I've noticed in the past year from my dealings with the "new" Board. I wish you the best of luck cause they seem to Fine me no matter what I have said at the "hearings".

That's ridiculous! My neighbor received several citations for having her garage door open. She got so frustrated she doesn't even use her garage anymore and parks out in the lot.

Not sure who is issuing the citations, whether it's a board member or a resident forwarding complaints to the management company, but they obviously have too much time on their hands. And they're obviously not dealing with the real issues at hand...like the partial patching and painting in the laundry room, the cracking plaster on the back side of the garages along Rolling Hills, the need for all the buildings to be powerwashed, the rusting and peeling paint on the wrought iron fences.

One question, do you water these planter boxes at all? Because I myself live in a lower unit and if even one drop of water fell down in my living and walking space I would adress the board to have them removed. Water droplets from plants cause staining on floors if not washed away. Also if someone around my unit has things hanging and it looks tacky I would also complain. I am lucky that in my "SECTION" we are very clean and have no hanging items. Your neighbors are not going to tell you directly because eveyone here is none confrontational. No one tells anyone anything, they just complain about it here on this blog and somehow blame it on Rene. By the way congrats to Rene,I guess more people think he's doing good than bad. I see it as only a handfull of people that have a problem with him anyways. Perhaps try moving to the southside of the complex. Its better over here.

Dear neighbor just to let you know,yuo're not the only resident here getting a citation of that matter or any other type.I get to know some residents and believe me they are tired of all the nonsense with the present HOA some one told me that our honorable president uses community areas as portable toilets,unfortunately there was no complaint to that,and things are not getting better at Park Ridge.Many of us have violatting the rules in the past and not to mention the present.We need to do something to fix a broken system.I understand Rene has great ideas,very polite person.Albert Einstein was a genius but his ideas brought damage to the human race.Golda in #126

Dear Blogger,

I am happy to see the direction that this blog is going in by not printing hurtful rants anymore. I think you provide a valuable service to the community. However, I would like to point out a few things that I hope you can address in the future:
First, there are rules in this community. You and others may consider them absurd, and that's all well and good. You have a right to your opinion as I do mine. I haven't lived here long enough to know what it was like before Rene, but I for one am glad we have these rules. We have them for a reason-If I were to be looking at a condo by Unit 71 and I were to see astro turf laying out to dry-I'd probably not want to buy here. Even though I'm not a board member, I'm sure they probably have to report what they see (if that makes any sense)-if you have it up for two minutes, you're breaking the rules. And planters hanging on the balcony I would think would compromise the structure of the balcony. Why can't the person find flower pot stands to put flowers up?
Second, like it or not folks, Rene is on the board again for another year. Did you vote? If you didn't, you only have yourselves to blame.
Third, how many of you people actually attend our Condo Owner Association meetings? I happen to attend them, and I don't think I've seen ANY of you there. (First poster I may remember) Pardon me if I'm wrong. How can you expect to fix a system that you're not part of?
And finally, blogger, how are comments such as these not hurtful rants-such as how they'll be fined for farting upwind, that Rene uses this land as a portable toilet, how he's like Albert Einstein with his dangerous ideas? I am a journalism school graduate, and we were NEVER allowed to print innuendo. I know that's the beauty of a blog, but blogger, I'd like to ask you to go a step above and NOT print things like that.

I hope this comment makes the light of day.

I'm sure that you receive quite a few comments that you do not post on this site, and in contrast to the woman above, I think that you have done a good job in walking the fine line between free expression (ie not just posting comments that replicate your own opinions) and curtailing some of the more negative/combative/explicit postings people submit. Thanks again for sticking with this blog (I'm sure its a source of endless entertainment at times) and providing the residents of Parkridge with a place to post and obtain helpful information regarding our community. You have a good point and I will take that into consideration when deciding weather or not to publish comments. Clearly I am an amateur and like to have a little fun. Though I am also sympathetic to our AMATURE leadership and appreciate the time they volunteer, I know they monitor/read the bolg and each has the opportunity to retort if motivated.

Rules do have there place but when Rene decides to change the way they are interpretted and 'fine' people for doing things that we were previously OK'd to do is not right. I know of quite a few people that were given $50 fines for laying the doormat over the gate for a few minutes while sweeping off patios (myself incuded and my gate was open while sweeping up). I had to miss a day of work to attend a "hearing" because the wind blew a piece of trash that happened to stop in the common area in front of my gate (Rene filed the complaint). I have no problem with the rules being enforced but Rene being THAT nit-picky is what I find Absurd (not the rules themselves). It's even worse when Fines are being given out to residents for violations that the Board members themselves or committing and getting away with.

I have only attended 2 meetings but its because of my work schedule. Please don't try to tell me that I don't care because my work hours are not as traditional as yours. If I had a typical 9-5 job, I would've tried to be on the Board myself. Since I don't, I'm stuck dealing with Rene and his crap. It's great that he wants to make this a nice place to live, I just think he goes about it in a bad way.

Thanks Tim in #40 that is exactly what happened to us. We love that rules are being enforced, but there needs to be some slack cut. If we leave something on our patio because we are clearly cleaning, we should not get fined. We also voted as well.

This is worse than Irvine!

The stupid pettyness of it. It all started with Rene and I don't know if the other board members are sycophants or if they truly believe this makes for good neighbors. Some of them seem like really decent people. What happened to them? Did they lose their voices or their conscience?

Of course the reserves have been run down and they need to be refilled - but are these pinprick fines the way to do it.

Pitchforks and torches anyone?
